Access and Use of the Website

You may only use the Website for non-commercial purposes and in accordance with these Terms.
We may, from time to time, restrict access to certain features, parts or content of the Website, or the entire Website, to users who have registered with us.
If you choose to open an account with us you must ensure that any registration details you provide are accurate. You are responsible for all activities that occur under your account and must notify us immediately of any unauthorized use or other security breach of which you become aware.
We reserve the right to disable any account, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms or if any details you provide for the purposes of registering as a user prove to be false.

Intellectual Property

1. All content and materials on the Website are the sole and exclusive property of Neil Felipp. You may not reproduce, by any means, in full or in part, distribute, publish, transmit, create derivative works based on, modify or sell any such content or materials contained on the Website.

2. Neil Felipp remains the owner of the creations relating to the products displayed on the Website. The Terms and Conditions do not grant you or any other person any entitlements of any kind to the intellectual property rights held by Neil Felipp.

3. These intellectual property rights prohibit the affixing of the Neil Felipp designs and/or its logos, or the insertion of photos of the products or their packaging in any material, including but not limited to brochures, posters, catalogues, correspondence, press articles, audiovisual works, without express prior written approval from Neil Felipp.

4. You agree to refrain from fabricating and/or arranging for the fabrication of, for itself or on behalf of third parties, products that are identical to, and/or similar to, and/or constituting imitations of the products displayed on the Website or derivative products within the meaning of intellectual property laws and regulations.

Ordering

All orders may only be placed on the Website by customers purchasing for personal use and not intended for resale. Any resale of Neil Felipp products purchased on the Website is strictly prohibited. By placing an order, you declare and guarantee that you act as a final consumer and that you do not intend to resell Neil Felipp products for commercial purposes.
Your purchase and order of products on this Website constitutes your agreement with Neil Felipp to comply with and be bound by the Terms and Conditions. For each order you place on the Website, your acceptance of the Terms and Conditions is in force as of the date of your order.
Neil Felipp reserves the right to cancel your order for any reason without liability if, among other things, the products are not available, are incorrectly priced or are otherwise incorrectly described.
We make every effort to show you images and descriptions of Neil Felipp Products which are accurate and realistic. The images are for illustrative purposes only. We cannot guarantee that a device's display of the colors accurately reflects the color of the Neil Felipp Products. Your Neil Felipp Products may vary slightly from those images. Sometimes we will need to make changes to our products to comply with laws and regulations, which may mean your Neil Felipp Products vary from the description.
The Website only accepts orders within the Philippines. For international orders, please email us at neilfelipp@gmail.com.

Product Availability

Products offered for sale and displayed on the Website are subject to availability. Neil Felipp shall not be liable in case of stock outage or unavailability of products.
Neil Felipp reserves the right to change the products offered for sale on the Website at any time and without notice.
Should the Product be unexpectedly unavailable, we will inform you by email or by phone as soon as possible. You will be invited to choose another available product on the Website as substitution for the unavailable product or to cancel your order. If you cancel your order, you will be refunded in the mode of payment used within 10 business days.
Customized products cannot be cancelled once the order is placed and we will not be able to provide a refund in connection with any customized product.

Price and Payment

All the prices of the Products published on the Website are expressed in Philippine Pesos and are inclusive of all applicable Philippines taxes but exclusive of shipping cost.
Neil Felipp hereby reserves the right to change the price of Products at any time, without prior notice, it being understood that the price charged to the user shall be the one indicated on the Website at the time the order was placed and will not take account of any variations, either increases or decreases, subsequent to the order confirmation.
Payment is due immediately upon confirmation of your order. We accept bank deposits and credit card payments through PayPal. We are unable to accept PayPal payment for exchanges.
Online payment transactions are subject to validation checks by your credit card issuer. We are not responsible if your card issuer declines to authorize payment for any reason.

Shipping and Delivery

Deliveries shall be made to the address specified in the order form. Please ensure that the shipping address provided is accurate.
Your order will be delivered within 3 to 7 working days. A tracking link will be sent to you in the Shipping Confirmation email.
Shipping cost within the Philippines shall be PhP350 and may be subject to change from time to time. We will inform you of any the shipping rates change.
All products within the same order cannot be split and delivered to different addresses.
Deliveries are made by courier Mondays to Saturdays, excluding holidays. It is not possible to specify a precise time at which a delivery will take place. The courier will contact you by SMS or Viber to confirm date and time of delivery. Please note that the courier will require deliveries to be signed for.
In the event of impediments to the delivery beyond our control or due to acts of God, we will inform you promptly by e-mail. We will not be held in any way responsible for any liability arising out of a delay caused by acts of third parties and/or acts of God.
In the event that the package has evidence of tampering or alteration, do not open the package and reply to your order confirmation email to inform us. Photos of the tampered package may be sent to assist us in our investigation.
In the event of non-delivery to the address specified due to the absence of the recipient, the courier will contact you to reschedule delivery. If these attempts are also unsuccessful, we will follow the procedure below.
1. The product will be shipped back to us.
2. After thirty days from the date on which the product has been returned to us, the contract will be considered as terminated and the purchase order canceled.
3. Neil Felipp will reimburse the amount paid, net of the cost of delivery of the product and the cost of returning the same to Neil Felipp. The termination of the contract and the refund amount will be communicated to the user via email. The refund amount will be credited to the payment mean used for the purchase.
4. In the event that, before the end of the thirty days, you ask to resend the purchased product, you will be charged the cost of returning the product to Neil Felipp and the cost of the second delivery.
Delivery is deemed complete when the product is received at the address specified in the order form. This marks the end of the of the sale.
It is your responsibility to check the conditions of the delivered product. Returns, exchanges and refunds will only be entertained within 7 days from receipt of your order.

Return and Exchange

At Neil Felipp, it is our purpose to provide beautiful products that are just as durable. However, as our products are hand-made, occasionally they may contain small imperfections. We also understand that sometimes people change their mind after making a purchase and may wish to return and exchange an item. Please read our policy for returns and exchanges carefully.

If you decide to return and exchange a product it must be done within 7 business days from receipt of your order.
Returned products must be in perfect condition and in their original packaging, together with the purchase invoice or a copy in the case of a partial return. We have sole discretion in determining whether the products purchased are in original condition when returned.
You may exchange an item for another item of lesser, equal or greater value.
1. If you exchange an item for another item of greater value, you will pay the difference in price.
2. If you exchange an item for another item of lesser value, you will be refunded within 10 business days of receipt of the item returned. and will be done by means of payment in which the order was made.
3. If you exchange an item, the shipping costs for the first delivery will not be refunded and you will be charged for the shipping costs of the second delivery.

Returns and exchanges should be sent in the original packaging via courier to Neil Felipp, Unit 06 – Corpin Area, #246 Don Gil Garcia Street, Brgy. Capitol Site, 6000 Cebu City, Philippines. Once we receive it we will examine the product’s condition and email you on how to proceed.

We do not accept returns and exchanges of the following items:
1. Any item that has been repaired or altered by a third party.
2. Custom made products.
3. Products purchased at a discount.
Only one exchange per item will be honored.
We follow the same policy for returns and exchanges of sales at pop ups and trunk shows. Please contact inquiries.neilfelipp@gmail.com for more details.

REFUND POLICY

We can process refunds for damaged or defective goods only.
We do not give refunds on the following items:
1. Any item that has been repaired or altered by a third party.
2. Custom made products.
3. Products purchased at a discount.
If you receive a damaged or defective item, reply to the order confirmation and state that you will begin a request for a refund. You can attach a photo of the damaged item.
Return the item in the original packaging via courier to Neil Felipp, Unit 06 – Corpin Area, #246 Don Gil Garcia Street, Brgy. Capitol Site, Cebu City Cebu, Philippines 6000. Once we receive the item, we will examine the product’s condition and e-mail you on how to proceed.
Refunds granted will be made within 10 business days of receipt of the product returned by and will be done by means of payment in which the order was made.

Liability Exclusion

The material contained in this Website may contain inaccurate information and typing errors. Neil Felipp does not warrant the accuracy of such information and declines any and all liability concerning losses or damage caused by these inaccuracies.
Neil Felipp reserves the right to change the Website and its contents at any time without an obligation to notify such change in advance or at a later date.
We cannot and do not guarantee that any content of the Website will be free from viruses and/or other code that may have contaminating or destructive elements.
